What is the USERRA?

The Uniformed Services Employment and Reemployment Rights Act affords military members certain rights regarding protection against discrimination in the workplace. The rights that are afforded by the USERRA are as follows:

  • Military members cannot be discriminated against in the workplace due to their service to the United States military.
  • Military members have a right to enforce the laws set out by the USERRA by the Veterans Employment and Training Service under the U.S. Department of Labor.
  • Military members who leave their civilian jobs to perform military service are entitled to reemployment once when returning from overseas or otherwise.
  • Military members have a right to health insurance coverage, as well as their dependents, for up to 24 months after leaving their civilian job to perform military duties.

Title I of the Americans with Disabilities Act also affords veterans with disabilities certain rights.
